General Terms and Conditions of LUXNULL

1. Scope and Contracting Party
These General Terms and Conditions apply to orders placed in the LUXNULL online shop. The contracting party is the natural person based in Switzerland named in the legal notice and contact information.

2. Offer and Conclusion of Contract
Product presentations in the shop constitute an invitation to place an order. During checkout, you can review and correct your entries. By clicking the final order button, you place a binding order for the goods listed at checkout. The contract is concluded as soon as we confirm the order by email or dispatch the goods. The electronic acknowledgement of receipt is sent automatically.

3. Prices and Shipping Costs
All prices are displayed in Swiss francs (CHF). Shipping costs and the total amount are shown before the order is completed. If no value-added tax is shown at checkout, Swiss value-added tax is not currently charged. Pricing or typographical errors may be corrected before the contract is concluded.

4. Payment
The payment methods shown at checkout are available. Charges are made in accordance with the terms of the selected payment provider. The goods remain our property until payment has been made in full.

5. Delivery
We deliver worldwide to the countries and regions available for selection at checkout. Shipping costs, processing time, transit time, and information on direct shipping, import duties, and shipment tracking are set out in the Shipping Policy. Partial deliveries are permitted insofar as they are reasonable and do not incur additional shipping costs.

6. Product Presentation and Availability
We describe NULL.ONE to the best of our knowledge. On-screen colors and shipping packaging may differ slightly from the presentation without affecting the product’s function or essential characteristics. If a product is unavailable after an order has been placed, we will notify you without delay and refund any payments already received.

7. Inspection Upon Receipt and Defects
Please inspect the delivery upon receipt and report any apparent damage, incorrect deliveries, or missing parts as soon as possible. A delayed report does not limit any mandatory statutory rights. In the event of a proven defect, we will provide remedies in accordance with statutory provisions, in particular replacement, repair, or reimbursement, insofar as applicable and reasonable.

8. Voluntary Returns
In addition to mandatory statutory rights, the voluntary 30-day right of return described in the Return and Refund Policy applies. Due to direct contact with the body, special hygiene requirements apply to voluntary returns.

9. Liability
We accept unlimited liability for damage caused intentionally or through gross negligence, as well as in cases of mandatory statutory liability. Liability for indirect damage or loss of profit is excluded to the extent permitted by law. This provision does not limit any mandatory claims relating to personal injury or product-related damage.

10. Not a Medical Device
NULL.ONE is a sleep mask and not a medical device. Product information does not constitute medical advice and does not promise treatment of sleep disorders.

11. Data Protection
Information on the processing of personal data is provided in the Privacy Policy.

12. Applicable Law
Swiss law applies, excluding conflict-of-law rules, insofar as no mandatory consumer protection provisions provide otherwise. Mandatory places of jurisdiction remain unaffected.

13. Amendments and Partial Invalidity
The version published at the time of the order shall apply. If any provision is invalid, the remaining provisions shall remain effective.
